1. Definitions

Throughout these Terms and Conditions, the following terms have specific meanings:

• "We," "Us," "Our," "Company": Refers to Onyx Drive, a luxury car rental service operating in Taiwan
• "You," "Client," "Renter": Refers to the individual or entity entering into a rental agreement with us
• "Vehicle": Any automobile provided by Onyx Drive under a rental arrangement
• "Rental Period": The duration from vehicle delivery to return as specified in the rental agreement
• "Services": All rental arrangements, support, and related offerings provided by Onyx Drive

2. Acceptance of Terms

By making a reservation, accepting vehicle delivery, or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

If you do not agree to these terms, you must not use our services. Your continued use of our services following any modifications to these terms constitutes acceptance of those changes.

3. Eligibility Requirements

To rent a vehicle from Onyx Drive, you must meet the following requirements:

• Be at least 18 years of age
• Hold a valid driver's license issued by a recognized authority
• International renters must present an International Driving Permit alongside their home country license
• Possess a valid credit card in the primary renter's name
• Provide valid identification (passport for international clients)
• Have the legal capacity to enter into binding agreements

4. Reservation and Payment

4.1 Reservation Process

Reservations can be made through our website, email, or phone contact. A reservation is confirmed only upon receipt of written confirmation from Onyx Drive, which will include rental details, pricing, and terms specific to your arrangement.

4.2 Payment Terms

Payment is due according to the following schedule:

• Full payment required before vehicle delivery
• Credit card authorization hold placed for security deposit
• Payment accepted in Taiwan Dollars (NT$)
• Additional charges for extensions or services billed separately

4.3 Cancellation Policy

Cancellations must be submitted in writing:

• More than 7 days before rental: Full refund minus 10% administrative fee
• 3-7 days before rental: 50% refund
• Less than 3 days before rental: No refund
• No-shows: No refund and full rental charge applies

5. Vehicle Use and Restrictions

5.1 Permitted Use

Vehicles may be operated within Taiwan on paved public roads. The vehicle must be operated:

• In compliance with all Taiwan traffic laws and regulations
• By the named renter or additional authorized drivers listed in the agreement
• With reasonable care and in accordance with the manufacturer's guidelines
• For lawful purposes only

5.2 Prohibited Activities

The vehicle must not be used for:

• Racing, testing, or any competitive driving events
• Towing or pushing other vehicles
• Off-road driving or unpaved terrain
• Transportation of illegal substances or contraband
• Commercial ride-sharing or taxi services
• Driving while under the influence of alcohol or drugs
• Transporting more passengers than the vehicle is designed to accommodate
• Operating the vehicle outside Taiwan without prior written consent

6. Insurance and Liability

6.1 Included Coverage

All rental arrangements include comprehensive insurance coverage provided through established Taiwan insurance carriers, including:

• Collision damage coverage
• Theft protection
• Third-party liability insurance

6.2 Renter Liability

You remain responsible for:

• Deductible amounts as specified in the insurance policy
• Damage resulting from prohibited uses or violations of this agreement
• Traffic violations, parking tickets, and toll charges incurred during the rental period
• Loss or damage to personal property left in the vehicle

7. Vehicle Condition and Inspection

Upon delivery, you will have the opportunity to inspect the vehicle. Any existing damage will be documented. You are responsible for reporting any new damage discovered during the rental period within 24 hours.

At return, the vehicle will be inspected for new damage, excessive wear, or cleanliness issues. Charges may apply for damage beyond normal wear or excessive cleaning requirements.

8. Accidents and Breakdowns

8.1 Immediate Notification

In the event of an accident, theft, or breakdown, you must:

• Contact Onyx Drive immediately via our 24/7 support line
• Contact local police if required by law or insurance procedures
• Document the incident with photographs if safe to do so
• Obtain contact information from other parties involved
• Not admit liability or fault at the scene

8.2 Vehicle Replacement

If the vehicle becomes undriveable due to mechanical failure not caused by misuse, we will arrange a replacement vehicle within two hours anywhere in Taiwan, at no additional cost.

9. Fuel and Maintenance

Vehicles are delivered with a full tank of appropriate fuel. You are responsible for:

• Using the correct fuel grade as specified in the vehicle documentation
• Returning the vehicle with a full tank (refueling charges apply otherwise)
• Monitoring fluid levels and tire pressure during the rental period
• Contacting us immediately if any warning lights or unusual sounds occur

10. Extensions and Modifications

Rental extensions are subject to vehicle availability and must be requested at least 24 hours before the scheduled return time. Extended periods may receive adjusted rates.

Unauthorized extensions (keeping the vehicle beyond the agreed return time without prior approval) will result in additional charges and may be considered breach of agreement.

Your personal information is handled in accordance with our Privacy Policy. Please review our Privacy Policy for details on how we collect, use, and protect your data.

12. Limitation of Liability

To the maximum extent permitted by Taiwan law:

• Our liability for any claim arising from vehicle rental is limited to the total rental fee paid
• We are not liable for indirect, consequential, or incidental damages
• We are not responsible for delays, route changes, or travel disruptions
• We are not liable for personal property left in vehicles
• These limitations do not affect your statutory rights under Taiwan consumer protection laws

13. Termination of Agreement

We reserve the right to terminate the rental agreement and reclaim the vehicle immediately if:

• The vehicle is used in violation of these terms
• Payment is not received as agreed
• We determine the vehicle is at risk or being misused
• You provide false information in the rental application

In such cases, no refund will be provided, and you remain liable for all charges and damages.

14. Intellectual Property

All content on our website and in our materials, including logos, text, graphics, and designs, are the intellectual property of Onyx Drive and are protected by Taiwan and international copyright laws. You may not reproduce, distribute, or use our intellectual property without written permission.

15. Dispute Resolution

In the event of a dispute:

• We encourage informal resolution through direct communication with our team
• Unresolved disputes shall be subject to mediation before pursuing legal action
• Any legal proceedings shall be conducted in Taiwan courts
• Taiwan law governs these terms and any disputes arising from them

16. Modifications to Terms

We may modify these Terms and Conditions at any time. Changes become effective upon posting to our website. Your continued use of our services after modifications constitutes acceptance of the updated terms. Material changes will be communicated to existing customers via email.

17. Severability

If any provision of these terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
